Yes, companies do hire people with DUIs to drive commercially

As someone who has been in a crash with a drunk truck driver, it may surprise you to know that new truck drivers may have a DUI or DWI in their pasts. The Federal Motor Carrier Safety Administration (FMCSA) states that a second DWI or DUI results in the disqualification of a driver from obtaining a commercial driver’s license for life. However, a single DWI will not.

Some companies will hire drivers even if they have a DUI or DWI in their pasts. Most do require that a significant amount of time has passed between the DWI or DUI before the driver can be hired. Usually, companies wait at least five to seven years after a person’s DWI or DUI cases is resolved before even considering hiring that driver. Many companies will not hire drivers with a past history of DWIs or DUIs, but many will as the conviction grows older. Some companies hire those with DWIs or DUIs in as little as two years.

What should you do if you’re hit by a drunk commercial driver?

If the person has a history of a DUI, then you are in a good position to get what you need out of his or her insurance company and potentially the employer as well. Employers are responsible for thoroughly checking on those who they hire. If they hire someone who has a history of drinking and driving, it may be possible to hold the company accountable for the crash.
