The National Highway Traffic Safety Administration reported 3,272 arrests for driving under the influence in 2022 in Tennessee. Some of these arrests for for accidents where people ended up with serious injuries.

Under the law, this is vehicular assault. It carries severe consequences that impact the lives of those involved.

Vehicular assault explained

Vehicular assault in Tennessee occurs when an individual operates a vehicle under the influence of alcohol or drugs and causes bodily injury to another person. The offense requires recklessness by driving with a blood alcohol limit of over 0.08% or being under the influence of a controlled substance or other drug that alters the central nervous system.

Penalties for vehicular assault

Vehicular assault is a Class D felony that comes with harsh penalties. After a conviction, individuals will lose their driver’s licenses for up to five years. The actual suspension depends on previous DUI convictions. While under suspension, a person cannot get restricted driving privileges. Penalties also include fines, court costs and a potential jail sentence of up to 12 years.

Beyond the immediate legal consequences, individuals with vehicular assault convictions often face long-term effects on their personal and professional lives. A felony record can impact employment opportunities. It can also make finding a place to live difficult, and it may lead to strained personal relationships.

Tennessee’s commitment to road safety is evident in its strict approach to vehicular assault resulting from DUI. The state aims not only to penalize offenders for their actions but also to deter others from engaging in similar risky behavior. This serves as a clear message that driving under the influence can alter the trajectory of one’s life.
